Marcus & Mack Helps Indiana County with Opioid Settlements

Marcus & Mack was recently featured in the Indiana Gazette for our involvement in settlements with several large pharmaceutical companies surrounding opioid misuse.

The Indiana County Board of Commissioners is involved in national litigation concerning the Big Three pharmaceutical distributors (McKesson, Cardinal Health, AmerisourceBergen) and Johnson & Johnson over their role in opioid misuse in Indiana County and surrounding areas. Our own skilled attorney Robert S. Marcus assisted the Indiana County Board of Commissioners with settlements from various pharmaceutical companies.

Fighting for the People

Marcus & Mack has been involved in Indiana County’s litigation to sign the terms of the Pennsylvania Opioid Misuse and Addiction Abatement Trust, which utilized a $26 billion opioid settlement.

That is not all. According to Marcus, “In addition to the $26 billion national settlements concerning the Big Three distributors and Johnson & Johnson, which, as of last year, began making payments, I am pleased to announce there are five additional proposed national settlements.” While these settlements will likely have an opt-in procedure before they take effect, an additional settlement as large as $20 billion may be coming soon, assuming 100 percent participation from all five pharmaceutical companies—which include CVS, Walgreens, Walmart, Teva Pharmaceuticals, and Allergan.

Community support must be consistent among affected areas, with the participation deadline ending in March. Marcus believes that communities should opt-in to participate in all five claims proposed to the Indiana County commissioners to unite support and speed up lengthy court proceedings.

“Even though I believe the claims are strong, there is risk, uncertainty, delay and expense associated with continued litigation against these entities,” Marcus stated. “When taken together and in addition to the funding from the existing settlements, the funding from the new settlement proposals is meaningful.”
