Attorney Bryan Neiderhiser: Many people call our offices and say that they have received a settlement offer for their injury claim from the insurance company. So you may be wondering: Why do I need a lawyer?
There are a couple of reasons why you need a lawyer in these circumstances. First, here at Marcus and Mack, we would work to increase that offer, develop and build your case, and maximize your recovery.
But a pitfall that many people who try to do this alone run into is an issue called subrogation. Subrogation is a term that is used when your health insurance company seeks to get its money reimbursed for the bills that it paid for your accident-related injuries.
Under the law, there are specific parameters that must be met before those companies can prove that they are actually entitled to that reimbursement.
We make sure those insurance companies prove that they are entitled to subrogation or reimbursement, including requiring that the companies provide us with the policy language that confirms a right of subrogation. Once that is done, we then negotiate with those insurance companies in an effort to reduce the amount of reimbursement, with the ultimate goal being to maximize the amount of recovery that our clients can put in their pockets.
