Attorney says decision affects hundreds of lawsuits involving weed killer
JULY 11, 2018 – A federal judge recently ruled that hundreds of lawsuits involving claims that Monsanto’s popular weed killer Roundup causes cancer can proceed through the court system, a victory for consumers seeking to hold the corporation responsible for serious health problems caused by their products, said attorney Robert Marcus of Marcus & Mack.
“This ruling is a victory for all Americans,” Marcus said. “Companies need to be held accountable for any dangerous or lethal side effects associated with their products. And there is strong evidence that Roundup causes cancer and Monsanto actively worked to hide such information from the public.”
“This ruling could have far-reaching effects,” Marcus added. “It doesn’t simply affect the hundreds of people who have already filed lawsuits. Other individuals harmed by Roundup can also take legal action across the country against Monsanto for injuries caused by this product.”
On July 10, U.S. District Court Judge Vince Chhabria rejected Monsanto’s request to have hundreds of lawsuits thrown out which have been filed against the company by people claiming they have cancer due to Roundup, according to numerous articles about the ruling, including USA Today and ABC News.
Since 1974, Roundup has been available for sale as an herbicide designed to kill weeds. The ingredient in Roundup which kills weeds is glyphosate. In recent years, there have been several studies that claim glyphosate causes non-Hodgkin’s lymphoma, a form of cancer. As a result, the World Health Organization classified glyphosate as a “probable human carcinogen” in 2015.
In response, Monsanto reportedly would “bully scientists” and “fight independent researchers” who claimed Roundup causes cancer in an effort to suppress such information, according to an attorney representing a client suing the company, according to The Guardian newspaper.
“Such scare tactics are appalling,” Marcus said. “Scientists have a right to do their job. And people have a right to take legal action against companies that sell dangerous products. If you have been harmed by Roundup, you deserve your day in court. You deserve justice.”
